DMCA & Intellectual Property Policy
Reporting alleged copyright or trademark infringement on the PulseCargo.ai™ platform.
PulseCargo.ai respects the intellectual property rights of others and expects its users to do the same. This policy describes how to report alleged intellectual property infringement on the PulseCargo.ai platform.
1. Copyright Infringement (DMCA)
If you believe that content on the PulseCargo.ai platform infringes your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing the following information to our designated agent:
A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Identification of the copyrighted work claimed to have been infringed.
Identification of the material that is claimed to be infringing and information reasonably sufficient to permit PulseCargo.ai to locate the material (e.g., URL or screenshot).
Your contact information, including address, telephone number, and email address.
A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.
2. Counter-Notification
If you believe that content you uploaded was wrongly removed due to a DMCA takedown notice, you may submit a counter-notification containing your contact information, identification of the removed material, a statement under penalty of perjury that you have a good faith belief the material was removed by mistake, and your consent to the jurisdiction of the federal court in your district.
3. Trademark Infringement
If you believe that content on the Platform infringes your trademark, please contact us at legal@pulsecargo.ai with details of the alleged infringement, including the trademark at issue and the infringing content.
4. DMCA Section 512(c) Designation Statement
Pursuant to 17 U.S.C. § 512(c)(3), the Designated Agent for service of DMCA notifications for alleged copyright infringement on the PulseCargo.ai platform is:

We ask that all DMCA correspondence be clear and specific regarding the allegedly infringing content and include all required information per 17 U.S.C. § 512(c)(3)(A).
5. Repeat Infringers
Pursuant to 17 U.S.C. § 512(i)(1)(A), PulseCargo.ai has adopted and implemented a policy that provides for the termination of accounts of users who are determined to be repeat infringers of intellectual property rights. While repeat infringement determinations are made on a case-by-case basis, PulseCargo will consider the number, nature, and severity of infringement notices, the user's response to notices, and other relevant factors in making such determinations.
6. Liability and Damages
PulseCargo.ai will not be liable to any user for removing or disabling access to content that is subject to a valid DMCA takedown notice, nor will PulseCargo be liable for restoring access to content that is subject to a valid counter-notification. Users whose content has been removed or disabled are responsible for filing a valid counter-notification to seek restoration.
7. Notification of Actions
When PulseCargo.ai receives a valid DMCA takedown notice, we will make reasonable efforts to notify the user whose content has been removed or disabled. Users may contact our Designated Agent to inquire about the status of a takedown notice or to submit a counter-notification.
8. False Statements and Perjury
Pursuant to 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability if such person initiates a takedown notice or counter-notification under the DMCA. This includes liability for damages and attorney's fees. Please be certain that you have a good faith belief that content infringes your copyright before submitting a DMCA notice.
